Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the hiprimal.com website (the "Service") operated by HiPrimal LLC ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you do not agree with any part of these Terms, you are not permitted to access or use the Service.
Communications
By creating an account on our Service, making a purchase, or otherwise providing your contact information, you agree that we may send you emails, newsletters, marketing or promotional materials, and other information. You may opt out of marketing emails at any time by using the unsubscribe link or instructions included in any email we send.
Purchases
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to provide certain information relevant to your Purchase, including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and (ii) the information you supply to us is true, correct, and complete.
The Service may use third-party services for payment processing and order fulfillment. By submitting your information, you grant us the right to provide the information to these third parties in accordance with our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons at our sole discretion.
We also reserve the right to refuse or cancel your order if fraud, unauthorized use, or an illegal transaction is suspected.
PHONE, SMS, MMS MESSAGING TERMS & CONDITIONS
HiPrimal LLC ("We", "Us", "Our") may offer one or more mobile messaging programs (the "Program"). By opting into or participating in the Program, you agree to these Mobile Messaging Terms and Conditions, as well as our Privacy Policy. By participating, you agree to resolve disputes with us through binding, individual arbitration as described in the “Dispute Resolution” section below. These terms are specific to the Program and are intended to supplement, not replace, our general Terms and Conditions and Privacy Policy.
User Opt-In: The Program allows users to receive SMS/MMS mobile messages by affirmatively opting in, such as through an online form, during checkout, or by texting a keyword. Regardless of the opt-in method, you agree that these terms govern your participation in the Program. By participating, you consent to receive marketing messages, including those sent using an automatic telephone dialing system (“autodialer”). Consent to receive such messages is not a condition of purchase. Message and data rates may apply. Message frequency may vary.
User Opt-Out: If you no longer wish to participate in the Program or no longer agree to these terms, you must reply with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us to opt out. You may receive a final message confirming your opt-out. You agree that these are the only reasonable methods of opting out. Any other attempt to opt-out (including texting alternative words or making a verbal request to an employee) may not be effective.
Program Description: Users who opt into the Program may receive messages related to the marketing and sale of HiPrimal supplements, educational content about our products, new product launches, promotions, giveaways, early access offers, cart or checkout reminders, and other brand-related updates.
Cost and Frequency: Message and data rates may apply. You agree to receive messages periodically at our discretion. The Program may involve recurring mobile messages, and additional messages may be sent based on your interaction with us (such as link clicks or responses).
Support Instructions: For help regarding the Program, you can reply HELP to any message you receive or email us at hi@hiprimal.com. Please note that emailing us is not a valid method of opting out of the Program. Opt-outs must be submitted by following the instructions in the “User Opt-Out” section above.
MMS Disclosure: If your mobile device does not support MMS messaging, the Program may send SMS text messages instead.
Disclaimer of Warranty for the Program: The Program is offered on an “as-is” basis. Delivery of messages depends on effective transmission from your wireless carrier and is outside our control. We are not liable for delays or failures in the receipt of any mobile messages connected with the Program. Mobile carriers are not responsible for delayed or undelivered messages.
Participant Requirements: To participate in the Program, you must own a wireless device capable of two-way messaging, use a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all carriers or devices may support the Program.
Age Restriction: You may not use or engage with the Program if you are under thirteen (13) years of age. If you are between thirteen (13) and eighteen (18) years old, you may only use the Program with the permission of your parent or legal guardian. By using or engaging with the Program, you represent and warrant that you meet these age requirements and that your use of the Program is permitted under applicable law.
Prohibited Content: You agree not to send or submit any prohibited content through or in connection with the Program. Prohibited content includes, but is not limited to:
- Fraudulent, defamatory, threatening, harassing, or stalking content or activity;
- Obscene, offensive, or discriminatory content, including hate speech, bigotry, or content that promotes violence or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
- Viruses, malware, worms, Trojan horses, or other harmful code;
- Content that promotes unlawful products, services, or activities;
- Content referencing or including protected health information subject to HIPAA or similar laws; and
- Any other content prohibited by applicable law in the jurisdiction from which the message is sent.
Additional Information
HiPrimal reserves the right to update or amend information on the Service at any time, including but not limited to prices, product descriptions, technical specifications, and product availability, without prior notice. If a product is sold out or unavailable, we may cancel your order and refund any amount paid. We may also offer an alternative or similar product where appropriate.
HiPrimal is not responsible for user-generated content, interactions between users, or third-party content that may appear on hiprimal.com.

Return Policy
We offer a 365-day return policy, which means you have 365 days after receiving your item to request a refund.
To be eligible for a refund, your last order must be within 365 days from the purchase date and your product must be shipped back to us. Only your most recent order qualifies for a refund (not all orders over time).
To start a return, please contact us at hi@hiprimal.com for instructions. Returns must be shipped back to us before we can process a refund.
Availability, Errors, and Inaccuracies
We are continually updating our offerings on the Service. We may occasionally experience delays in updating information on the Service or in our advertising on other websites. The information on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable, and we do not guarantee the accuracy or completeness of any information on the Service.
We reserve the right to correct errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Service or related advertising is inaccurate, at any time and without prior notice.
Contests, Sweepstakes, and Promotions
Any contests, sweepstakes, or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will control.
Content
Our Service may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content you post on or through the Service, including its legality, reliability, and appropriateness.
By posting Content on or through the Service, you represent and warrant that: (i) you own the Content or have the right to use it and to grant us the license described in these Terms; and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity. We reserve the right to terminate accounts of users who infringe intellectual property rights.
You retain any rights you may have to the Content you submit, post, or display on or through the Service and you are responsible for protecting those rights. We assume no responsibility for Content posted by you or any third party on or through the Service. However, by posting Content using the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, publicly perform, publicly display, distribute, and otherwise utilize such Content in connection with operating and improving the Service.
HiPrimal has the right, but not the obligation, to monitor, edit, or remove any Content submitted by users.
All other content found on or through the Service is the property of HiPrimal or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use such content, in whole or in part, for commercial purposes or personal gain, without our prior written permission.
Accounts
When you create an account with us, you represent that you are at least 18 years of age and that the information you provide is accurate, complete, and current at all times. Failure to do so may result in immediate termination of your account.
You are responsible for maintaining the confidentiality of your account and password, including restricting access to your device and account. You agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity, a name not lawfully available for use, a name or trademark subject to any rights of another person or entity without appropriate authorization, or any name that is offensive, vulgar, or obscene.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Copyright Policy
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes the copyright or other intellectual property rights (“Infringement”) of any person or entity.
If you are a copyright owner, or authorized on behalf of one, and you believe that any content on the Service infringes your copyright, please send a notice to hi@hiprimal.com with the subject line "Copyright Infringement" and include a detailed description of the alleged infringement as outlined below under “DMCA Notice and Procedure for Copyright Infringement Claims.”
You may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that any content is infringing.
DMCA Notice and Procedure for Copyright Infringement Claims
You may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our designated Copyright Agent with a written notice that includes substantially the following:
- Your physical or electronic signature;
- Identification of the copyrighted work claimed to have been infringed, or a representative list of such works if multiple are covered by one notice;
- Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (such as the URL of the page where it appears);
- Your contact information, including your address, telephone number, and email address;
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

Intellectual Property
The Service and its original content (excluding user-generated Content), features, and functionality are and will remain the exclusive property of HiPrimal and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by HiPrimal.
HiPrimal has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not endorse or warrant the offerings of any of these entities or their websites.
You acknowledge and agree that HiPrimal shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.
We strongly recommend that you read the terms and conditions and privacy policies of any third-party websites or services you visit.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.
If you wish to terminate your account, you may simply stop using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Indemnification
You agree to defend, indemnify, and hold harmless HiPrimal, its affiliates, licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including but not limited to attorneys’ fees), resulting from or arising out of (a) your use and access of the Service by you or any person using your account; (b) your breach of these Terms; or (c) Content that you post on the Service.
Limitation of Liability
In no event shall HiPrimal, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or Content of any third party on the Service; (iii) any Content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or Content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if any remedy set forth herein is found to have failed of its essential purpose.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
HiPrimal, its subsidiaries, affiliates, and licensors do not warrant that (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements or expectations.
Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so some of the limitations above may not apply to you.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in full force and effect. These Terms constitute the entire agreement between us regarding the Service and supersede and replace any prior agreements we may have had regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we may provide notice (for example, by email or by posting an updated version on this page) prior to the new terms taking effect. What constitutes a material change is determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.
Arbitration & Class Action Waiver
EXCEPT WHERE PROHIBITED BY LAW, YOU AGREE THAT ANY CLAIM OR DISPUTE YOU MAY HAVE AGAINST HIPRIMAL, OR ITS PARENTS, SUBSIDIARIES, AFFILIATES, OWNERS, EMPLOYEES, OR REPRESENTATIVES, WILL BE RESOLVED BY FINAL AND BINDING INDIVIDUAL ARBITRATION, AND YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.
This arbitration agreement is governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1–16. If you intend to seek arbitration, you must first send written notice of your claim to HiPrimal by certified or registered mail, describing the nature and basis of the claim and the specific relief sought. The notice should be sent to: [Insert HiPrimal Legal Address]. If the parties do not reach an agreement to resolve the claim within thirty (30) days after the notice is received, you or HiPrimal may commence arbitration.
The arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable rules, including the Consumer Arbitration Rules. Unless otherwise agreed, the arbitration shall take place in the capital city of the state in which you reside, or may be conducted by telephone or video conference where the total amount in dispute is below a certain threshold allowed by the applicable rules.
You agree that you may bring claims only in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of a representative or class proceeding.
Reselling
Unauthorized reselling of HiPrimal products is restricted. Wholesale customers may resell HiPrimal products only through their own business website or approved channels, and must comply with any minimum advertised pricing (MAP) or other reseller policies we communicate in writing.
Reselling on third-party marketplaces (such as Amazon, eBay, etc.) without our explicit written consent is strictly prohibited. We reserve the right to terminate wholesale relationships, refuse future orders, and pursue legal remedies in the event of unauthorized resale or violation of our reseller policies.
